Report: State Supreme Court Judge denies New York's ban on flavored vaping products

ALBANY, NY- New York’s executive order to ban flavored vaping products has been blocked by a state judge.

The Associated Press reports that acting State Supreme Court Justice Catherine Cholakis officially determined that New York’s Public Health and Planning Council overstepped its authority this past fall, when the Governor announced a statewide ban on e-cigarettes and flavored e-liquids (except tobacco and menthol).

According to Judge Cholakis, it is not the job of the state executive branch to regulate the vaping industry, but rather a task for lawmakers in the legislature.

In retaliation to the ban, the Vapor Technology Association, along with two of its member businesses, challenged the ban, resulting in the judge accepting their motion for an injunction against enforcing the ban.
